ARTICLE 1 – DEFINITIONS

Reflection Period: The timeframe during which the consumer may exercise their right of withdrawal.
Consumer: A natural person not acting in a professional or commercial capacity who enters into a distance contract with the company.
Day: January 1, 2024.
Ongoing Transaction: A distance agreement under which products or services are supplied regularly over a longer period.
Durable Medium: Any tool allowing consumer or company to store information for future access and unchanged reproduction.
Right of Withdrawal: The ability for the consumer to terminate the distance agreement within the reflection period.
Company: The natural or legal entity offering products or services at a distance.
Distance Agreement: An agreement concluded as part of a system organized by the company for remote sales using one or more means of remote communication exclusively.

ARTICLE 3 – APPLICABILITY

These terms apply to every offer and distance agreement between the company and the consumer. Before a distance agreement is concluded, these terms will be provided to the consumer. If this is not reasonably possible, the company will indicate how these terms can be accessed electronically or provided free of charge upon request.

If specific product or service terms apply alongside these terms, the consumer will always benefit from the most favorable provision in case of conflicting terms.


ARTICLE 4 – THE OFFER

Offers will clearly state:

  • The price, excluding import VAT and customs fees, which are payable by the customer.

  • Shipping costs.

  • Payment, delivery, and execution terms.

  • Applicability of the right of withdrawal.

  • Any conditions, such as limited validity.

Images and descriptions will be as accurate as possible, although small variations such as color differences may occur.


ARTICLE 5 – THE AGREEMENT

An agreement is concluded once the consumer accepts the offer and complies with the conditions. For electronic agreements, the company will confirm receipt without delay. Until confirmation is received, the consumer may cancel the agreement.

The company ensures secure data transmission for electronic agreements and payments.


ARTICLE 6 – RIGHT OF WITHDRAWAL

Consumers may withdraw from the agreement within 14 days of receiving the product without stating a reason. Products must be returned in their original condition and packaging. Consumers are responsible for return shipping costs.


ARTICLE 7 – EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

  • Custom-made or personalized products

  • Perishable goods

  • Sealed products that cannot be returned after opening for hygiene reasons


ARTICLE 8 – PAYMENT

Payments must be made within seven days unless otherwise agreed. Consumers must report payment data errors immediately. In case of non-payment, the company may charge reasonable fees.


ARTICLE 9 – DELIVERY

Delivery takes place at the address provided by the consumer. Orders are typically processed quickly, usually within 30 days, unless a longer period is agreed. If delays occur, the consumer may cancel the agreement and receive a refund.


ARTICLE 10 – WARRANTY

Products and services will meet the agreement specifications and legal standards. Warranty claims are valid only if reported within 14 days of delivery. The warranty does not apply if:

  • Products are modified by the consumer

  • There is misuse or improper handling


ARTICLE 11 – CHANGES

We reserve the right to modify these terms at any time. Continued use of the website after changes constitutes acceptance of the updated terms.


ARTICLE 12 – LONG-TERM CONTRACTS: DURATION, TERMINATION & RENEWAL

Termination

  • Consumers may terminate open-ended agreements for regular delivery at any time, with a maximum notice of one month.

  • Fixed-term agreements may be terminated at the end of the term with a maximum one-month notice.

  • Termination may occur:

    • At any time

    • By the same method used to enter the agreement

    • With the same notice period as required by the company

Renewal

  • Fixed-term agreements may not be automatically renewed except:

    • Newspaper/journal subscriptions may renew for up to three months, provided consumers may cancel with one month’s notice

  • Agreements may convert to open-ended only if consumers may cancel with one month’s notice

Duration

  • Agreements over one year may be cancelled after one year with a maximum one-month notice unless earlier termination is unreasonable.


ARTICLE 13 – COMPLAINTS PROCEDURE

Complaints must be reported promptly within seven days of discovery. The company will acknowledge complaints within 14 days and may provide a resolution timeframe if additional time is needed. If unresolved, the matter becomes a dispute under the dispute-resolution clause.


ARTICLE 14 – DISPUTES

All agreements are governed by U.S. law, even if the consumer resides outside the U.S. Disputes fall under U.S. jurisdiction.


ARTICLE 15 – PERSONAL DATA

Personal data provided through the website is subject to our Privacy Policy. Please refer to it for more details.


ARTICLE 16 – ERRORS & OMISSIONS

The website may occasionally contain pricing, description, or availability errors. We reserve the right to correct errors, update information, or cancel orders affected by inaccuracies, even after submission.

We are not obligated to update information unless required by law.


ARTICLE 17 – SERVICE TERMS UPDATES

We reserve the right to modify these service terms. Updates will be posted on this page. Continued use of the website constitutes acceptance.


ARTICLE 18 – CESOP

From 2024, payment service providers may record data in the European CESOP system in line with VAT law and Payment Service Directive regulations.


ARTICLE 19 – LIABILITY

Limitations
We are not liable for direct, indirect, incidental, punitive, or consequential damages arising from the use of our website, products, or services, unless due to gross negligence or intentional misconduct.

Force Majeure
We are not responsible for delays or failures caused by events beyond our control, such as government restrictions, natural disasters, or technical failures.

Indemnification
You agree to indemnify 2 ECOM LIMITED, its affiliates, employees, and partners from claims arising from violation of these terms or any law or third-party rights.


ARTICLE 20 – INTELLECTUAL PROPERTY

All intellectual property rights relating to our website, services, and products remain the property of 2 ECOM LIMITED or its licensors. You may not reproduce or modify materials without prior written consent.


ARTICLE 21 – SEVERABILITY

If any provision is deemed unlawful, void, or unenforceable, the remaining terms remain valid. Invalid provisions will be replaced with legally valid ones closest to the original intent.


ARTICLE 22 – ENTIRE AGREEMENT

These terms, along with any posted policies, constitute the entire agreement and supersede prior communications.


ARTICLE 23 – TERMINATION

We may suspend or terminate access without notice if terms are violated or illegal activity occurs. Upon termination, access rights cease immediately and any outstanding obligations remain.
